Many of AI tools base their training on various data types, including works protected by royalties, a fact that raises concerns regarding the respect of royalties and their non-transparent, unlicensed use, especially when training sets are created that include protected works through data mining.
The law stipulates that AI service providers may use works protected by royalties, within the context of data mining activities, provided that they have obtained access to them legally and that the creator hasn’t exercised their opt-out right.
AUTODIA aims to ensure that its members’ royalty-protected works will not become part of AI development without their explicit consent.
In this context, by exercising the opt-out right, which AUTODIA initiated in December of 2023, it explicitly declares that it excludes the reproduction and extraction of works from its represented repertoire for the purpose of data mining, in accordance with Article 21B of Law 2121/1993, which transposes Article 4 of Directive 2019/790.
AI providers using the works of AUTODIA’s members for the purpose of data mining within its represented repertoire - especially to feed their training data bases – must obtain previous relevant licensing from the Greek Organization and explicitly negotiate the terms to ensure that the royalties’ holders are compensated fairly and appropriately.
Furthermore, the development of general - purpose AI models create new income sources from the commercial exploitation of its artistic products. However, human creative content constitutes the raw material for AI business models that are evolving rapidly, attracting major investments and generating significant profits for AI providers. Consequently, creators and royalties’ holders must be part of this value chain through a fair remuneration model.
Throughout this period, AUTODIA has been working intensively, alongside peer organizations and unions of creators and artists abroad, to shape the appropriate legal and political framework. This framework aims to ensure that AI providers comply with existing legislation regarding royalties and related rights.
