An AI tool cannot be recognized as the creator - or even as a co-creator - of a protected work. However, when an author uses AI as an auxiliary tool, in combination with their own sufficient creative contribution and original idea, to create a musical composition, that composition is considered a protected work.

Since the works of the creators represented by AUTODIA have been opted out of the training models of AI systems, any AI-generated output included in playlists for commercial use is subject to dispute and may result in legal penalties, in addition to any obligations and penalties that may apply under the AI Regulation and relevant EU and national legislation for providers and operators of AI systems.

Am I legally protected if I use AI-powered music services in my store?

We recommend that you exercise extreme caution when using music services marketed as Artificial Intelligence (AI) products, because music generated by AI systems is not always free of copyright restrictions. The use of AI-generated music creates legal uncertainty; it does not exempt users from paying royalties to collecting societies, except under specific circumstances, and therefore its use is not recommended.
